Terms of Service

• "RLTR", "we", "us" means One Two Spark, Co., a Delaware corporation operating the rltr service, reachable at the address in section 20.
• "Services" means the RLTR application at app.rltr.homes, the marketing site at rltr.homes, our mobile-friendly web screens, APIs, signing pages and any related support.
• "Agency" means the workspace created when an account is registered. An Agency owns the records inside it and pays for its active seats.
• "Customer" or "you" means the Agency, and the person who accepted these terms on its behalf, as well as each member using the Services under that Agency.
• "Authorized User" means a member of an Agency with their own sign-in: owner, admin, agent or assistant.
• "Customer Data" means everything you or your Authorized Users put into the Services: contacts and lead lists, notes, call results, emails and messages, documents and signatures, deals, properties, tasks, templates, scripts, recordings and settings.
• "End Customer" means a person whose information is in Customer Data: a lead, a client, a signer, a caller.
• "Applicable Laws" means every law that applies to your use of the Services, including the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule and the National Do Not Call Registry rules, state telemarketing and call-recording laws, CAN-SPAM, state privacy laws such as the CCPA/CPRA, fair housing and real estate licensing law, and the rules of your MLS and brokerage.

Registration. You must be at least 18, give accurate information and keep it current. If you register an Agency for a brokerage or team, you confirm you have authority to bind it to these terms. New Agencies start empty; nothing is created until the verification email is confirmed and a password is chosen.

Security. You are responsible for your password, for every action taken under your sign-in and for the people you invite. Tell us straight away at the contact in section 20 if you suspect unauthorized access. We may reset credentials or sign everyone out when we believe an account is at risk.

Roles. Owners and admins see and manage the whole Agency, including inviting and removing members, enabling calling and changing settings. Agents and assistants see the records assigned to them. Removing a member revokes their access, disconnects the mailboxes and calendars they connected, and leaves their records in the Agency for reassignment.

One active Agency per email. An email address can hold one active membership at a time. Accounts are personal and may not be shared or transferred.

While your subscription is active and you comply with these terms, we grant you a limited, non-exclusive, non-transferable right to use the Services for your Agency's internal real estate business. You may not: resell, sublicense or offer the Services to third parties as a service; copy, modify or create derivative works of the Services; reverse engineer or attempt to extract source code except where the law expressly allows it; scrape or bulk-download content other than your own Customer Data through the export tools; probe, scan or test the vulnerability of the Services without our written permission; interfere with other Agencies or with our infrastructure; remove notices; or use the Services to build a competing product.

We improve the Services continuously. Features may change, be added or be retired, and where a capability is not available yet the app says so on the screen. We will tell you about changes that materially reduce functionality you pay for.

You are responsible for your Customer Data and for how you use the Services. You represent and warrant that:

• you have the right to collect, store and use every item of Customer Data in the Services, including any consents, notices or disclosures that Applicable Laws require;
• your use of the Services, and every call, email and document you send through them, complies with Applicable Laws and with your brokerage's and MLS's rules;
• you honour opt-outs, unsubscribes and do-not-call requests promptly, and you maintain the internal do-not-call list the law requires, for which rltr's DNC status and number suppressions are a tool, not a substitute for your own compliance process;
• you keep the eligibility review and acknowledgments the app asks for truthful and current;
• you do not use the Services for anything unlawful, deceptive, discriminatory, harassing or infringing, including steering or other fair-housing violations.

RLTR does not give legal advice. Screens, hints, documents and this site describe how the software works; they do not tell you what the law requires of your business. Please talk to your broker, association or lawyer about compliance.

Calling. RLTR calling, single calls and power-dialer sessions place calls through a telephone carrier on your instruction, using numbers you verify or that are provisioned for your Agency. You decide whom to call and when. Before a session or call starts you confirm that your Agency has reviewed calling eligibility and do-not-call lists for those contacts; RLTR enforces calling hours (8am–9pm in the recipient's time zone), do-not-call statuses and number suppressions as safeguards, but these do not replace your own obligations. If you record calls or play recorded messages, you are responsible for the consents and announcements that the laws of every relevant state require. Carrier fines, penalties or fees that result from your use (for example illegal robocalls, spoofing or ignored opt-outs) are yours to pay.

Email. Mailboxes you connect stay your mailboxes; RLTR sends and receives through them on your instruction. Campaign and bulk email must comply with CAN-SPAM and the sending rules of your mail provider, include a working unsubscribe, and honour unsubscribes recorded in RLTR.

Limits. We may apply reasonable limits (for example daily calling allowances, list sizes, upload sizes and rate limits) to protect the Services, our carriers and other customers, and we may suspend calling or sending that we reasonably believe is unlawful or abusive.

Yours. Customer Data belongs to your Agency. We claim no ownership of it. You grant us the limited right to host, copy, process, transmit and display Customer Data as needed to provide, secure and support the Services, to comply with law, and as otherwise described in the Privacy Notice.

Isolated. Each Agency works in its own isolated space. Members of one Agency cannot see another's records. Private mailboxes are visible only to the member who connected them, not to administrators; email threads explicitly shared with a contact are visible to members permitted to access that contact. Google data remains subject to the Limited Use restrictions in the Privacy Notice, including restrictions on aggregated data and business transfers.

Portable. Owners and admins can export the Agency's data from the app at any time, or request assistance with a copy of Customer Data in a common format. Contact us before closing your account to arrange export.

End Customers. Between you and RLTR, you are responsible for End Customers' rights and requests. If an End Customer contacts us about data you hold, we will refer them to you unless the law requires us to act.

Aggregated information. We may use information about how the Services are used, in a form that does not identify you or any End Customer, to operate, secure and improve the Services.

RLTR is a CRM, not a vault for regulated data. Do not put into the Services: Social Security or other government identification numbers; full payment card numbers, bank account numbers or other financial account data; protected health information; biometric data; precise geolocation history; information about anyone under 16; or any other data whose storage would subject RLTR to specific regulatory obligations (for example PCI DSS, HIPAA or GLBA). Property details, contact details, notes about a transaction and signed real estate documents are fine. If such data reaches us anyway, we may delete it and will notify you.

The Services, including their software, design, text, images, screens, documentation and the look and feel of the product and this site, belong to RLTR and its licensors and are protected by copyright, trademark and other laws. Except for the right in section 3 and your rights in Customer Data, nothing in these terms gives you any right in the Services. Product screens on this site show sample data.

If you send us ideas, suggestions or bug reports, you agree we may use them without restriction or payment. We will never publish a customer's name or quote as a testimonial without permission.

Automated subscription billing is not currently enabled. Any paid service requires an order or written agreement stating prices, billing intervals, renewal, cancellation and refund conditions before charges begin. Current prices or marketing examples do not by themselves authorize recurring charges. Contact hello@rltr.homes with billing questions.

Integrations. The Services connect to third parties you choose: your email provider (Google, Microsoft or an IMAP/SMTP server), calendar feeds and telephone carriers. Those services have their own terms and privacy policies, we do not control them, and we are not responsible for their availability or for what they do with your data. Connecting one means you authorize RLTR to exchange data with it on your behalf.

Beta and preview features. We may offer features marked beta, preview or "coming soon". They may change or be withdrawn without notice, may not work as described and are provided as is.

You will defend, indemnify and hold harmless RLTR, its owners, employees and contractors from any claim, demand, fine, penalty, loss and expense (including reasonable legal fees) arising from: your Customer Data; your calls, messages and emails; your breach of these terms or of Applicable Laws; a dispute between you and an End Customer, Authorized User or third party; or carrier fines caused by your use. We will notify you promptly of any such claim and cooperate with you at your expense. You may not settle a claim in a way that admits fault on our behalf without our written consent.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, RLTR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, THAT CALLS OR MESSAGES WILL BE DELIVERED, THAT DATA WILL NOT BE LOST, OR THAT USING THE SERVICES WILL MAKE YOUR BUSINESS COMPLIANT WITH ANY LAW. We keep backups as described in the Privacy Notice, but you are responsible for keeping your own copies of Customer Data that matters to you. Some jurisdictions do not allow certain disclaimers, so some of these may not apply to you.

TO THE FULLEST EXTENT PERMITTED BY LAW, RLTR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST COMMISSIONS, LOST DATA, LOST GOODWILL OR THE COST OF SUBSTITUTE SERVICES, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES IN ANY TWELVE-MONTH PERIOD WILL NOT EXCEED THE FEES YOUR AGENCY PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. These limits do not apply to liability that cannot be limited by law, and they are an essential basis of the bargain between us. We are not responsible for disputes between you and End Customers, other Agencies or third parties.

The configured application and database hosting region is Frankfurt, Germany. Connected providers may process data in other countries, including the United States, as described in the Privacy Notice. You are responsible for ensuring your use of the Services and any international data transfers comply with applicable law.

Term. These terms apply from your first use and continue while your Agency has an account.

By you. An owner may request account closure by emailing hello@rltr.homes. Any paid agreement governs its cancellation and remaining access period.

By us. We may suspend or terminate access, with notice where practicable, if you materially breach these terms, fail to pay, use the Services in a way that creates legal or security risk for us or others, or if a carrier, provider or law requires it. For breaches that can be cured we will give you 14 days to cure before terminating, except where the breach is unlawful use, a security risk or repeated.

Effects. On termination your right to use the Services ends, outstanding fees become due, and we handle Customer Data as described in the Privacy Notice: export and deletion arranged with the Agency, subject to legal retention requirements. Sections that by their nature should survive (ownership, payments owed, indemnification, disclaimers, limitation of liability, governing law and general terms) survive.

These terms are governed by the laws of the United States and of the State of Delaware, without regard to conflict-of-law rules. Any dispute that we cannot resolve informally will be brought in the state or federal courts located in Delaware, and both of us consent to their jurisdiction. Before filing, you agree to write to us at the address in section 20 describing the dispute and to allow 30 days for us to try to resolve it. Each party waives trial by jury to the extent permitted by law. Nothing prevents either party from seeking an injunction to protect its intellectual property or Customer Data.

• Entire agreement. These terms, the Privacy Notice, any applicable billing policy, order or written agreement with us are the whole agreement about the Services and replace earlier understandings. If a written agreement conflicts with these terms, the written agreement wins for that Agency.
• Assignment. You may not assign these terms without our consent, except to a successor of your whole business who accepts them. We may assign them to an affiliate or successor.
• Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control, including carrier or hosting outages, internet failures, acts of government, natural disasters, epidemics or labour disputes, except for payment obligations.
• Notices. We send notices to the Agency owner's email address and may post notices in the app. You send notices to the address in section 20.
• Export and sanctions. You may not use the Services in violation of United States export or sanctions laws, or if you are on a United States government restricted-party list.
• Severability and waiver. If a provision is unenforceable it will be limited to the minimum extent necessary and the rest remains in force. Not enforcing a provision is not a waiver of it.
• No third-party beneficiaries. These terms create no rights for anyone other than you and RLTR.

If you believe content in the Services infringes your copyright, send a notice to the contact in section 20 with: a description of the work and of the material you say infringes it and where it is; your contact details; a statement that you believe in good faith the use is not authorized; a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. We will remove or disable access to material that a valid notice identifies and may terminate repeat infringers.

We may update these terms as the Services and the law change. For material changes we will email the Agency owner and post a notice in the app at least 30 days before they take effect, and we will update the effective date at the top of this page. Continuing to use the Services after the effective date means you accept the updated terms; if you do not, cancel before then. Changes required by law or to address a security risk may take effect sooner.
